{"id":647,"date":"2016-02-05T09:59:49","date_gmt":"2016-02-05T08:59:49","guid":{"rendered":"https:\/\/www.bdpsencik.cz\/?p=647"},"modified":"2016-02-05T09:59:49","modified_gmt":"2016-02-05T08:59:49","slug":"hlasovani-per-rollam","status":"publish","type":"post","link":"https:\/\/www.bdpsencik.cz\/?p=647","title":{"rendered":"Hlasov\u00e1n\u00ed per rollam"},"content":{"rendered":"<p>V\u00e1\u017een\u00ed \u010dlenov\u00e9 bytov\u00e9ho dru\u017estva \u201eP\u0161en\u010d\u00edk\u201c,<\/p>\n<p>v\u00a0souladu s\u00a0\u010dl. 42 odst. 2 stanov Bytov\u00e9ho dru\u017estva \u201eP\u0161en\u010d\u00edk\u201c si V\u00e1s dovoluji po\u017e\u00e1dat o \u00fa\u010dast p\u0159i hlasov\u00e1n\u00ed <em>per rollam<\/em> o dvou ot\u00e1zk\u00e1ch:<\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Ot\u00e1zka 1: Vytvo\u0159en\u00ed nov\u00e9ho dru\u017estevn\u00edho pod\u00edlu k\u00a0bytu 313<\/strong><\/h3>\n<p>Na podzim r. 2015 informovalo p\u0159edstavenstvo o uvoln\u011bn\u00ed bytu \u010d. 313, kter\u00fd byl dosud pronaj\u00edm\u00e1n a s\u00a0jeho\u017e n\u00e1jmem dosud nebyl spojen\u00fd \u017e\u00e1dn\u00fd dru\u017estevn\u00ed pod\u00edl. Analogicky k\u00a0postupu v\u00a0p\u0159ede\u0161l\u00e9m podobn\u00e9m p\u0159\u00edpad\u011b p\u0159edstavenstvo navrhlo, aby byl byt \u201eprod\u00e1n\u201c a nap\u0159\u00ed\u0161t\u011b podl\u00e9hal stejn\u00e9mu re\u017eimu, jako v\u011bt\u0161ina byt\u016f v\u00a0na\u0161em dom\u011b \u2013 p\u0159esn\u011bji, aby k\u00a0uvoln\u011bn\u00e9mu bytu byl vytvo\u0159en nov\u00fd dru\u017estevn\u00ed pod\u00edl. \u00a014. \u0159\u00edjna 2015 jsme vyzvali z\u00e1jemce o \u010dlenstv\u00ed v\u00a0dru\u017estvu k\u00a0pod\u00e1v\u00e1n\u00ed nab\u00eddek na v\u00fd\u0161i \u010dlensk\u00e9ho vkladu. Nakonec jedinou nab\u00eddku podali dosavadn\u00ed \u010dlenov\u00e9 dru\u017estva, man\u017eel\u00e9 \u0160vr\u010dulovi, kte\u0159\u00ed nab\u00eddli dal\u0161\u00ed \u010dlensk\u00fd vklad ve v\u00fd\u0161i 1\u00a0902\u00a0000 K\u010d.<\/p>\n<p>V\u00a0p\u0159\u00edloze p\u0159edkl\u00e1d\u00e1me n\u00e1vrh smlouvy o p\u0159evzet\u00ed povinnosti k\u00a0\u00fahrad\u011b dal\u0161\u00edho \u010dlensk\u00e9ho vkladu, jej\u00ed sou\u010d\u00e1st\u00ed je i n\u00e1vrh n\u00e1jemn\u00ed smlouvy. Podle \u010dl. 39 odst. 1 p\u00edsm. s) stanov dru\u017estva mus\u00ed tuto smlouvu schv\u00e1lit \u010dlensk\u00e1 sch\u016fze. P\u0159edstavenstvo proto \u017e\u00e1d\u00e1, aby \u010dlensk\u00e1 sch\u016fze hlasov\u00e1n\u00edm <em>per rollam <\/em>p\u0159ijala n\u00e1sleduj\u00edc\u00ed rozhodnut\u00ed:<\/p>\n<p><strong>\u010clensk\u00e1 sch\u016fze schvaluje smlouvu o p\u0159evzet\u00ed povinnosti k\u00a0\u00fahrad\u011b dal\u0161\u00edho \u010dlensk\u00e9ho vkladu ve v\u00fd\u0161i 1\u00a0902\u00a0000 K\u010d za \u00fa\u010delem nabyt\u00ed pr\u00e1va k\u00a0n\u00e1jmu bytu \u010d. 313 s\u00a0man\u017eeli \u0160vr\u010dulov\u00fdmi v\u00a0p\u0159edlo\u017een\u00e9m zn\u011bn\u00ed.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<h3><strong>Ot\u00e1zka 2: Souhlas s\u00a0podn\u00e1jmem bytu \u010d. 217 na dobu 3 let<\/strong><\/h3>\n<p>Dne 1. \u0159\u00edjna 2015 po\u017e\u00e1dala \u010dlenka dru\u017estva, pan\u00ed Platilov\u00e1, o prodlou\u017een\u00ed souhlasu s\u00a0podn\u00e1jmem bytu \u010d. 217. Vzhledem k\u00a0tomu, \u017ee podn\u00e1jemn\u00edk je cizinec a ka\u017ed\u00e9 prodlou\u017een\u00ed podn\u00e1jmu s\u00a0sebou nese v\u011bt\u0161\u00ed administrativn\u00ed z\u00e1t\u011b\u017e, po\u017e\u00e1dala o souhlas s\u00a0podn\u00e1jmem na dobu del\u0161\u00ed ne\u017e rok. Dosavadn\u00ed podn\u00e1jem prob\u00edhal bez probl\u00e9m\u016f.<\/p>\n<p>Podle \u010dl. 27 odst. 2 stanov dru\u017estva m\u016f\u017ee p\u0159edstavenstvo ud\u011blit souhlas s\u00a0podn\u00e1jmem jen na dobu nep\u0159esahuj\u00edc\u00ed jeden rok; na del\u0161\u00ed dobu jej m\u016f\u017ee ud\u011blit \u010dlensk\u00e1 sch\u016fze. P\u0159edstavenstvo proto \u017e\u00e1d\u00e1, aby \u010dlensk\u00e1 sch\u016fze hlasov\u00e1n\u00edm <em>per rollam<\/em> p\u0159ijala rozhodnut\u00ed:<\/p>\n<p><strong>\u010clensk\u00e1 sch\u016fze ud\u011bluje souhlas s\u00a0podn\u00e1jmem bytu \u010d. 217 na dobu do 31. 1. 2019. Sou\u010dasn\u011b stanov\u00ed n\u00e1sleduj\u00edc\u00ed podm\u00ednky podn\u00e1jmu:<\/strong><\/p>\n<p><strong> 1. Podn\u00e1jemn\u00edk bude dodr\u017eovat domovn\u00ed \u0159\u00e1d, bude byt a d\u016fm u\u017e\u00edvat v\u00a0souladu s\u00a0dobr\u00fdmi mravy a bude se p\u0159im\u011b\u0159en\u011b \u0159\u00eddit stanovami dru\u017estva a rozhodnut\u00edmi org\u00e1n\u016f dru\u017estva.<\/strong><\/p>\n<p><strong>2. Byt bude u\u017e\u00edvat nejv\u00fd\u0161e p\u011bt osob.<\/strong><\/p>\n<p><strong>\u00a0<\/strong><strong>\u00a0<\/strong><\/p>\n<h3><strong>Postup p\u0159i hlasov\u00e1n\u00ed <em>per rollam<\/em><\/strong><\/h3>\n<p>Hlasov\u00e1n\u00ed <em>per rollam<\/em> se \u0159\u00edd\u00ed <a title=\"Vnit\u0159n\u00ed p\u0159edpisy\" href=\"https:\/\/www.bdpsencik.cz\/?page_id=459\" target=\"_blank\">stanovami dru\u017estva<\/a>, konkr\u00e9tn\u011b \u010dl. 42 odst. 2. P\u0159edstavenstvo zas\u00edl\u00e1 v\u0161em \u010dlen\u016fm dru\u017estva n\u00e1vrh rozhodnut\u00ed a jeho od\u016fvodn\u011bn\u00ed (tj. tento dopis). \u010clen\u016fm dru\u017estva, kte\u0159\u00ed maj\u00ed koresponden\u010dn\u00ed adresu v\u00a0na\u0161em bytov\u00e9m dom\u011b, budou tyto dokumenty vlo\u017eeny do schr\u00e1nky; pros\u00edme o vypln\u011bn\u00ed a vr\u00e1cen\u00ed dodejky, kter\u00e1 je k\u00a0nim p\u0159ipojen\u00e1. Ostatn\u00edm zas\u00edl\u00e1me stejn\u00e9 materi\u00e1ly po\u0161tou.<\/p>\n<p>\u010clen\u016fm dru\u017estva, kte\u0159\u00ed nepotvrd\u00ed dod\u00e1n\u00ed z\u00e1silky, se ji pokus\u00edme znovu doru\u010dit osobn\u011b a p\u0159i ne\u00fasp\u011bchu jim stejnou z\u00e1silku za\u0161leme po\u0161tou. Podle \u010dl. 52 odst. 3 stanov dopisy odes\u00edl\u00e1me s\u00a0desetidenn\u00ed odb\u011brn\u00ed lh\u016ftou, pot\u00e9 nast\u00e1v\u00e1 fikce doru\u010den\u00ed. Pros\u00edme o v\u010dasn\u00e9 vracen\u00ed dodejek, nebo\u0165 opakovan\u00e9 zas\u00edl\u00e1n\u00ed je pracn\u00e9 a n\u00e1kladn\u00e9.<\/p>\n<p><strong>Lh\u016fta pro vyj\u00e1d\u0159en\u00ed \u010din\u00ed 15 dn\u00ed od doru\u010den\u00ed tohoto n\u00e1vrhu.<\/strong> Lze se vyj\u00e1d\u0159it pouze \u201esouhlas\u00edm\u201c nebo \u201enesouhlas\u00edm\u201c, tj. nen\u00ed mo\u017en\u00e9 se zdr\u017eet hlasov\u00e1n\u00ed. Pokud ve stanoven\u00e9 lh\u016ft\u011b nebude doru\u010den souhlas (tj. nedoraz\u00ed \u017e\u00e1dn\u00e1 odpov\u011b\u010f, odpov\u011b\u010f je nejednozna\u010dn\u00e1 apod.), pova\u017euje se to automaticky za nesouhlas. Hlasovat lze pomoc\u00ed p\u0159ilo\u017een\u00e9ho hlasovac\u00edho l\u00edstku prost\u0159ednictv\u00edm schr\u00e1nky dru\u017estva nebo zasl\u00e1n\u00edm po\u0161tou. Hlas je mo\u017en\u00e9 odevzdat tak\u00e9 e-mailem; vzor hlasovac\u00edho l\u00edstku pro tyto \u00fa\u010dely zas\u00edl\u00e1me \u010dlen\u016fm dru\u017estva elektronicky.<\/p>\n<p>Ke schv\u00e1len\u00ed ka\u017ed\u00e9ho n\u00e1vrhu je t\u0159eba, aby z\u00edskal v\u011bt\u0161inu z\u00a0celkov\u00e9ho po\u010dtu \u010dlen\u016f dru\u017estva. V\u00fdsledky hlasov\u00e1n\u00ed zve\u0159ejn\u00ed p\u0159edstavenstvo kr\u00e1tce po jeho skon\u010den\u00ed (p\u0159i zapo\u010dten\u00ed v\u0161ech lh\u016ft o\u010dek\u00e1v\u00e1me konec hlasov\u00e1n\u00ed na p\u0159elomu \u00fanora a b\u0159ezna).<\/p>\n<p>&nbsp;<\/p>\n<p><strong>V\u00fdpis z\u00a0evidence dru\u017estva<\/strong><\/p>\n<p>Sou\u010dasn\u011b s\u00a0t\u00edmto dopisem V\u00e1m zas\u00edl\u00e1me tak\u00e9 v\u00fdpis z\u00a0evidence \u010dlen\u016f dru\u017estva. Pros\u00edm o pe\u010dlivou kontrolu a p\u0159\u00edpadn\u011b opravu nebo dopln\u011bn\u00ed \u00fadaj\u016f. Podepsan\u00fd formul\u00e1\u0159 laskav\u011b vra\u0165te p\u0159edstavenstvu do 15 dn\u016f.
