{"id":317,"date":"2015-02-14T14:08:33","date_gmt":"2015-02-14T13:08:33","guid":{"rendered":"https:\/\/www.bdpsencik.cz\/?p=317"},"modified":"2018-09-27T16:56:19","modified_gmt":"2018-09-27T14:56:19","slug":"hlasovani-per-rollam-rozdeleni-skladovacich-koji","status":"publish","type":"post","link":"https:\/\/www.bdpsencik.cz\/?p=317","title":{"rendered":"Hlasov\u00e1n\u00ed per rollam &#8211; rozd\u011blen\u00ed skladovac\u00edch k\u00f3j\u00ed"},"content":{"rendered":"<p>V souladu s\u00a0\u010dl. 42 odst. 2 stanov Bytov\u00e9ho dru\u017estva \u201eP\u0161en\u010d\u00edk\u201c \u017e\u00e1d\u00e1 p\u0159edstavenstvo \u010dleny bytov\u00e9ho dru\u017estva\u00a0o \u00fa\u010dast p\u0159i hlasov\u00e1n\u00ed <em>per rollam<\/em> o rozd\u011blen\u00ed skladovac\u00edch k\u00f3j\u00ed (\u201eskl\u00edpk\u016f\u201c).<\/p>\n<p>Rozhodnut\u00ed je pot\u0159ebn\u00e9 pro ukon\u010den\u00ed pasportizace budovy. C\u00edlem je ur\u010dit, zda a jak\u00fdm zp\u016fsobem budou k\u00f3je p\u0159i\u0159azeny k\u00a0bytov\u00fdm jednotk\u00e1m jako jejich p\u0159\u00edslu\u0161enstv\u00ed. Toto p\u0159i\u0159azen\u00ed se odraz\u00ed v\u00a0n\u00e1jemn\u00edch smlouv\u00e1ch uzav\u00edran\u00fdch podle p\u0159edpisu 90\/2012 Sb., z\u00e1kon o obchodn\u00edch korporac\u00edch, \u00a7\u00a0741 a n\u00e1sl. a m\u011blo by do budoucna zp\u0159ehlednit a zjednodu\u0161it pom\u011bry a evidenci v\u00a0dru\u017estvu. V\u00a0p\u0159\u00edpad\u011b, \u017ee by se \u010dlensk\u00e1 sch\u016fze v\u00a0budoucnu rozhodla, \u017ee dru\u017estvo pod\u00e1 prohl\u00e1\u0161en\u00ed vlastn\u00edka jako nutn\u00fd krok pro p\u0159\u00edpadn\u00fd p\u0159evod byt\u016f do osobn\u00edho vlastnictv\u00ed, bude p\u0159id\u011blen\u00ed skladovac\u00edch k\u00f3j\u00ed k\u00a0byt\u016fm v\u00a0takov\u00e9m prohl\u00e1\u0161en\u00ed obsa\u017een\u00e9.<\/p>\n<p>Bytov\u00e9 dru\u017estvo disponuje v\u00edce ne\u017e 90 skladovac\u00edmi k\u00f3jemi, jejich po\u010det je tedy v\u011bt\u0161\u00ed ne\u017e po\u010det byt\u016f. St\u00e1vaj\u00edc\u00ed rozd\u011blen\u00ed je dan\u00e9 historicky a namnoze ji\u017e neodpov\u00edd\u00e1 p\u016fvodn\u00edm z\u00e1m\u011br\u016fm.<\/p>\n<h3><\/h3>\n<h3><strong>V\u00fdsledky nez\u00e1vazn\u00e9 ankety<\/strong><\/h3>\n<p>Na podzim roku 2014 uspo\u0159\u00e1dalo p\u0159edstavenstvo nez\u00e1vazn\u00e9 dotazn\u00edkov\u00e9 \u0161et\u0159en\u00ed, jak by m\u011bly b\u00fdt skladovac\u00ed k\u00f3je rozd\u011bleny. Byly nab\u00eddnuty t\u0159i varianty \u0159e\u0161en\u00ed: (1) zachovat st\u00e1vaj\u00edc\u00ed stav, tj. ka\u017ed\u00e9mu bytu p\u0159id\u011blit k\u00f3je, kter\u00e9 aktu\u00e1ln\u011b u\u017e\u00edv\u00e1; (2) ka\u017ed\u00e9mu bytu p\u0159id\u011blit jednu k\u00f3ji; (3) k\u00a0byt\u016fm 3+1 p\u0159i\u0159adit po jedn\u00e9 k\u00f3ji a k\u00a0byt\u016fm 2+kk po dvou k\u00f3j\u00edch.<\/p>\n<p>P\u0159edstavenstvo obdr\u017eelo celkem 38 odpov\u011bd\u00ed, kter\u00e9 byly pom\u011brn\u011b vyrovnan\u011b rozd\u011blen\u00e9 mezi nab\u00eddnut\u00e9 mo\u017enosti:<\/p>\n<ul>\n<li>15 respondent\u016f zvolilo mo\u017enost \u201eke ka\u017ed\u00e9mu bytu p\u0159id\u011blit po jedn\u00e9 k\u00f3ji\u201c,<\/li>\n<li>13 respondent\u016f zvolilo \u201ezachovat st\u00e1vaj\u00edc\u00ed stav, tj. ka\u017ed\u00e9mu bytu p\u0159id\u011blit k\u00f3je, kter\u00e9 aktu\u00e1ln\u011b u\u017e\u00edv\u00e1\u201c,<\/li>\n<li>10 respondent\u016f bylo pro mo\u017enost \u201ek byt\u016fm 3+1 p\u0159id\u011blit po jedn\u00e9 k\u00f3ji, k\u00a0byt\u016fm 2+kk po dvou\u201c.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Dal\u0161\u00ed ot\u00e1zka se t\u00fdkala up\u0159esn\u011bn\u00ed varianty, \u017ee by ke ka\u017ed\u00e9mu bytu byla zapsan\u00e1 jedna skladovac\u00ed k\u00f3je. V\u00a0tom p\u0159\u00edpad\u011b by z\u016fstal ur\u010dit\u00fd po\u010det \u201eskl\u00edpk\u016f\u201c bez pevn\u00e9ho p\u0159i\u0159azen\u00ed k\u00a0n\u011bkter\u00e9mu bytu. Nab\u00edzely se t\u0159i mo\u017enosti, jak s\u00a0nimi nalo\u017eit: (A) d\u00e1t je k\u00a0dispozici bezplatn\u011b s\u00a0t\u00edm, \u017ee pr\u00e1vo k\u00a0jejich u\u017e\u00edv\u00e1n\u00ed p\u0159ednostn\u011b z\u00edskaj\u00ed dosavadn\u00ed u\u017eivatel\u00e9; uvoln\u011bn\u00e9 k\u00f3je se budou obsazovat podle po\u0159ad\u00ed \u017e\u00e1dost\u00ed; (B) d\u00e1t je k\u00a0dispozici za drobnou \u00faplatu, \u0159\u00e1dov\u011b 20 K\u010d za m\u011bs\u00edc; (C) pronaj\u00edmat je za tr\u017en\u00ed n\u00e1jemn\u00e9. Nejv\u00edce respondent\u016f (8) bylo pro pron\u00e1jem za drobnou \u00faplatu, 4 \u017e\u00e1dali pron\u00e1jem za tr\u017en\u00ed n\u00e1jemn\u00e9, jedna odpov\u011b\u010f \u017e\u00e1dala bezplatn\u00e9 u\u017e\u00edv\u00e1n\u00ed.<\/p>\n<p>K\u00a0t\u00e9to dopl\u0148kov\u00e9 ot\u00e1zce se v\u00e1zalo i n\u011bkolik odpov\u011bd\u00ed psan\u00fdch voln\u011b. \u0160lo p\u0159ev\u00e1\u017en\u011b o n\u00e1vrhy na poskytnut\u00ed nep\u0159i\u0159azen\u00fdch skl\u00edpk\u016f za \u00faplatu v\u00a0r\u016fzn\u00e9 v\u00fd\u0161i, pop\u0159\u00edpad\u011b na stanovov\u00e1n\u00ed v\u00fd\u0161e n\u00e1jmu t\u011bchto k\u00f3j\u00ed podle aktu\u00e1ln\u00ed popt\u00e1vky.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Po vyhodnocen\u00ed ankety navrhuje p\u0159edstavenstvo n\u00e1sleduj\u00edc\u00ed postup:<\/strong><strong>\u00a0<\/strong><\/p>\n<ol>\n<li><strong>Ke ka\u017ed\u00e9mu bytu bude zaps\u00e1no po jedn\u00e9 skladovac\u00ed k\u00f3ji.<\/strong><\/li>\n<li><strong>K\u00f3je, kter\u00e9 nebudou pevn\u011b p\u0159i\u0159azen\u00e9 k\u00a0\u017e\u00e1dn\u00e9mu bytu, budou a\u017e do p\u0159\u00ed\u0161t\u00ed \u010dlensk\u00e9 sch\u016fze ponech\u00e1ny dosavadn\u00edm u\u017eivatel\u016fm k\u00a0bezplatn\u00e9mu u\u017e\u00edv\u00e1n\u00ed.<\/strong><\/li>\n<li><strong>Na nejbli\u017e\u0161\u00ed \u010dlensk\u00e9 sch\u016fzi bude projedn\u00e1no, za jak\u00fdch podm\u00ednek se budou poskytovat k\u00a0u\u017e\u00edv\u00e1n\u00ed k\u00f3je bez pevn\u00e9ho p\u0159i\u0159azen\u00ed k\u00a0byt\u016fm, tj. zda budou nad\u00e1le ponech\u00e1ny u\u017eivatel\u016fm bezplatn\u011b \u010di za poplatek a jak\u00fdm zp\u016fsobem by takov\u00fd poplatek byl stanoven.<\/strong><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Navr\u017een\u00e9 \u0159e\u0161en\u00ed umo\u017en\u00ed dokon\u010dit pasportizaci budovy a aktualizaci n\u00e1jemn\u00edch smluv podle nov\u00fdch p\u0159edpis\u016f. Odpov\u00edd\u00e1 p\u0159itom variant\u011b p\u0159id\u011blen\u00ed skl\u00edpk\u016f, pro kterou se vyslovila nejv\u011bt\u0161\u00ed \u010d\u00e1st \u010dlen\u016f dru\u017estva.<\/p>\n<p>Dal\u0161\u00edmu jedn\u00e1n\u00ed naopak z\u016fst\u00e1v\u00e1 otev\u0159en\u00e1 ot\u00e1zka, jak nalo\u017eit s\u00a0k\u00f3jemi, kter\u00e9 nebudou pevn\u011b zaps\u00e1ny jako sou\u010d\u00e1st konkr\u00e9tn\u00edho bytu. Podrobn\u011bj\u0161\u00ed projedn\u00e1n\u00ed t\u00e9to podot\u00e1zky pova\u017eujeme za spr\u00e1vn\u00e9, nebo\u0165 n\u00e1zory na ni v\u00a0nez\u00e1vazn\u00e9 anket\u011b byly r\u016fznorod\u011bj\u0161\u00ed, pro jednotliv\u00e9 varianty se vyslovil jen mal\u00fd po\u010det respondent\u016f a objevilo se i n\u011bkolik nov\u00fdch n\u00e1vrh\u016f \u0159e\u0161en\u00ed.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<h3><strong>Postup p\u0159i hlasov\u00e1n\u00ed <em>per rollam<\/em><\/strong><\/h3>\n<p>Jeliko\u017e hlasov\u00e1n\u00ed <em>per rollam<\/em> je institut, kter\u00fd dosud nebyl v\u00a0na\u0161em dru\u017estvu vyu\u017eit, pop\u00ed\u0161i podrobn\u011bji jeho pr\u016fb\u011bh. Z\u00e1vazn\u011b jej upravuj\u00ed stanovy dru\u017estva, konkr\u00e9tn\u011b \u010dl. 42 odst. 2.<\/p>\n<p>Rozhodov\u00e1n\u00ed <em>per rollam<\/em> stoj\u00ed na rove\u0148 usnesen\u00ed \u010dlensk\u00e9 sch\u016fze. Rozd\u00edl je v\u00a0tom, \u017ee se nehlasuje osobn\u011b p\u0159i sch\u016fzi, ale p\u00edsemn\u011b. K\u00a0n\u00e1vrhu rozhodnut\u00ed se lze vyj\u00e1d\u0159it pouze \u201esouhlas\u00edm\u201c nebo \u201enesouhlas\u00edm\u201c, nen\u00ed mo\u017en\u00e9 se zdr\u017eet hlasov\u00e1n\u00ed.<\/p>\n<p>&nbsp;<\/p>\n<p>V\u0161ichni \u010dlenov\u00e9 bytov\u00e9ho dru\u017estva obdr\u017e\u00ed p\u00edsemn\u011b n\u00e1vrh rozhodnut\u00ed a jeho od\u016fvodn\u011bn\u00ed (d\u011bje se tak t\u00edmto dopisem). Do 15 dn\u016f od doru\u010den\u00ed lze vyj\u00e1d\u0159it sv\u016fj souhlas nebo nesouhlas. <strong>Pokud v\u00a0uveden\u00e9m term\u00ednu nebude doru\u010den souhlas (tj. nedoraz\u00ed \u017e\u00e1dn\u00e1 odpov\u011b\u010f, ale tak\u00e9 nap\u0159. odpov\u00ed-li \u010dlen dru\u017estva nejednozna\u010dn\u011b), pova\u017euje se to automaticky za nesouhlas.<\/strong> Ke schv\u00e1len\u00ed rozhodnut\u00ed je t\u0159eba souhlasu v\u011bt\u0161iny z\u00a0celkov\u00e9ho po\u010dtu \u010dlen\u016f dru\u017estva (tedy alespo\u0148 34 hlas\u016f).<\/p>\n<p>&nbsp;<\/p>\n<p>Pro hladk\u00fd pr\u016fb\u011bh hlasov\u00e1n\u00ed V\u00e1s pros\u00edm o dodr\u017een\u00ed n\u00e1sleduj\u00edc\u00edch pokyn\u016f:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>Pokud jste v\u00fdzvu k hlasov\u00e1n\u00ed obdr\u017eeli do domovn\u00ed schr\u00e1nky a\u00a0je k\u00a0n\u011bmu p\u0159ipojen\u00e1 <strong>doru\u010denka<\/strong>, vypl\u0148te ji, pros\u00edm, a vra\u0165te do schr\u00e1nky dru\u017estva. To se samoz\u0159ejm\u011b net\u00fdk\u00e1 t\u011bch, komu byl dopis zasl\u00e1n po\u0161tou. Pokud se n\u00e1m doru\u010denka nevr\u00e1t\u00ed b\u011bhem n\u011bkolika dn\u00ed, pokus\u00edme se V\u00e1m dopis doru\u010dit znovu osobn\u011b. V\u00a0p\u0159\u00edpad\u011b ne\u00fasp\u011bchu V\u00e1m jej nech\u00e1me doru\u010dit po\u0161tou.<\/li>\n<li>Vyj\u00e1d\u0159en\u00ed k\u00a0n\u00e1vrhu rozhodnut\u00ed mus\u00ed b\u00fdt jednozna\u010dn\u00e9 (<strong>\u201esouhlas\u00edm\u201c nebo \u201enesouhlas\u00edm\u201c<\/strong>), p\u00edsemn\u00e9 a mus\u00ed b\u00fdt z\u0159ejm\u00e9, kter\u00fd \u010dlen dru\u017estva hlasuje. Lze jej odevzdat na p\u0159ilo\u017een\u00e9m hlasovac\u00edm l\u00edstku do schr\u00e1nky dru\u017estva nebo po\u0161tou. Hlasovat je mo\u017en\u00e9 tak\u00e9 elektronickou po\u0161tou zaslanou na adresu info@bdpsencik.cz, pokud jsou dodr\u017een\u00e9 v\u00fd\u0161e uveden\u00e9 z\u00e1sady. V\u0161em \u010dlen\u016fm, kte\u0159\u00ed maj\u00ed v\u00a0evidenci dru\u017estva zapsanou e-mailovou adresu, zas\u00edl\u00e1m vzor odpov\u011bdi. V\u00a0ka\u017ed\u00e9m p\u0159\u00edpad\u011b je t\u0159eba vyj\u00e1d\u0159en\u00ed doru\u010dit <strong>do 15 dn\u016f<\/strong>.<\/li>\n<li>Podobn\u011b jako je hlasov\u00e1n\u00ed na \u010dlensk\u00e9 sch\u016fzi v\u011bt\u0161inou ve\u0159ejn\u00e9, i toto hlasov\u00e1n\u00ed je jmenovit\u00e9. Seznam \u010dlen\u016f dru\u017estva a jejich vyj\u00e1d\u0159en\u00ed k\u00a0n\u00e1vrhu bude k\u00a0dispozici u p\u0159edstavenstva.<\/li>\n<li>V\u00fdsledky hlasov\u00e1n\u00ed zve\u0159ejn\u00ed p\u0159edstavenstvo kr\u00e1tce po jeho skon\u010den\u00ed vyhl\u00e1\u0161kou na n\u00e1st\u011bnk\u00e1ch v\u00a0dom\u011b, na webov\u00fdch str\u00e1nk\u00e1ch dru\u017estva a informac\u00ed rozeslanou elektronickou po\u0161tou.
